General terms and conditions of sale
1 Preamble
AUTHENTIC SPIRITS specifies that its online sales are exclusively reserved for consumers of legal age, equal to or greater than eighteen (18) years old and twenty-one (21) years old for other countries whose legislation requires it, who agree to fill in the mandatory fields presented at the time of the order and who have a delivery address located in one of the countries served by AUTHENTIC SPIRITS.
The present general conditions of sale govern the relations between AUTHENTIC SPIRITS (a simplified joint stock company with a capital of €5000, whose registered office is at 21 B avenue Eglé 78600 Maisons-Laffitte, registered in the Versailles Trade and Companies Register under number 883501512) and its customers (hereinafter referred to as "the Customer") of the www.authentic-spirits.com website (hereinafter referred to as "the Site"), with the exception of all other conditions applicable to sales through other distribution and marketing channels.
2.acceptance of the general and special conditions of sale
Any order placed on the Site implies acceptance of these general terms and conditions of sale (products, quantities, prices, delivery times, etc.). It is specified that the Customer has the possibility to correct or modify his choices before confirmation. The modifications of the general conditions of sale are opposable to the Customers of the Site as from their setting on line and cannot apply to the transactions concluded previously. The Site therefore invites the Customer to carefully reread the general terms of sale in force for each new order, said terms being available for consultation online at the Site's address and available on request at contact@authenticspirits.com
3.Offer
3.1 Products offered
Each item offered on the Site is the subject of a presentation indicating its name, its main characteristics, its volume and its price. The photographs of the products are not contractual.
3.2 Period of validity of the offer
Our offer of products is valid only during the period of presentation online and is understood to be within the limits of available stocks, the indications on the availability of products being provided at the time of placing the order. In case of unavailability of the product after placing the order, we will contact the customer by phone or email as soon as possible to inform him and to agree with him:
- to postpone delivery until the product is replenished, when possible,
- cancel the order and refund the price paid within thirty days of its payment.
3.3. Prices
The prices on the Site are expressed in euros and take into account the value added tax on the day of the order. Any change in the applicable rate of value added tax will automatically be reflected in the price of the products on the Site. The total price including VAT indicated in the order confirmation is the total price of the order including all taxes and including the price of the products and the shipping costs.
4. customer identification
When placing an order on the Site, the Customer is asked to fill out a form and one or more questionnaires. The Customer undertakes to check all the information provided, its accuracy and its conformity. AUTHENTIC SPIRITS cannot be held responsible for the consequences of any input errors.
5.Ordering
5.1 Confirmation of the order
Any order entry is simultaneously summarized before the Customer is invited to confirm his order by indicating his choices regarding the billing address, delivery address, delivery method and payment method. The Customer is then invited to validate his order.
Any order is considered final only when the payment centers concerned have given their agreement. In case of refusal of the said centers, the order is automatically cancelled and the Customer is warned by a message on the screen by the payment center.
5.2 Confirmation of receipt of the order
AUTHENTIC SPIRITS confirms to the Customer the receipt of his order. This confirmation is automatically communicated to the Customer by e-mail summarizing the products ordered, the billing address, the delivery address and indicating an order number. The information given by the Customer when placing the order is binding on the Customer: in the event of an error by the Customer in the wording of his contact details or those of the place of delivery, in particular his surname, first name, address, telephone number, e-mail address, door code, floor resulting in the loss of the products, the Customer remains responsible for the payment of the lost products and no compensation or reimbursement can take place.
5.3. Payment
The payment of an order on the Site is made by credit card. The Customer is then redirected to the secure Crédit Mutuel Monetico site, which guarantees the preservation of the confidentiality of card numbers through protection and encryption procedures. Only cards bearing the logos Carte Bleu / Visa and Mastercard are accepted. The invoice will be available from the Customer's account.

The parcel will be delivered to the address indicated by the sender against the signature of the addressee or that of any person attached to his service, living with him or specially mandated or by any other method of provision agreed between the addressee and La Poste. Where applicable, the digitized signature of the recipient, of any person attached to his service, living with him, or of the person specially mandated, as well as its reproduction, shall constitute proof of delivery of the package. The Parties acknowledge that this signature has the same legal value as a signature on a paper document. The refusal of signature on the support presented by the Post Office is equivalent to a refusal of the sending.
The parcel will be delivered to the address indicated against the transmission of a confidential code to the agent of the Post Office which must correspond to the code recorded in the information system of this one. The concordance of the codes makes proof of delivery of the parcel and is worth signature. The confidential code will be transmitted by La Poste to the recipient by SMS or email before the delivery of the parcel. |
Deadlines | Orders are shipped within seventy-two (72) hours of receipt of payment.
Depending on the product and the country, delivery times can vary from several days to weeks (see 6.2 for estimated delivery times). |

Retention period | In Relay Point® : Packages are available in Point Relais® during 7 days, this period can go up to 14 calendar days according to the constraints of the activity.
Packages that have not been collected or that have been refused by the Customer at the end of the period of availability will be returned to AUTHENTIC SPIRITS via the drop-off Point Relais®. The Customer may request a refund of his order, by bank transfer, check or on the bank card used for the purchase, with the exception of the shipping costs and the return shipping costs invoiced by MONDIAL RELAY. The refund will be made within a maximum of seven days following receipt of the returned products. |
When the parcel could not be delivered according to the modalities envisaged above, several presentations of the parcel could take place as from the following day, at the initiative of the Post office or its partner abroad.
A notice of pending delivery indicating the contact details of the Contact Point where the addressee may collect the item is left by La Poste in the addressee's mailbox. Any item thus placed on hold is handed over to the addressee or to his or her agent, duly authorized for this purpose, upon presentation of an identity document or any other document authorized by the Post Office and against signature if it is a parcel delivered against signature. For parcels delivered on the national territory, the duration of the pending period is 15 consecutive days from the day following the deposit of the pending notice, except in the case of an exceptional extension of the period decided by La Poste. This period varies from 5 to 15 days for international shipments depending on the collection point chosen by the Customer. This period starts to run from the day after the last presentation at home. After this period, the package is returned to AUTHENTIC SPIRITS. |
Reception

The transfer of risks will take place upon receipt of the delivery by the Customer who will assume, as of this date, full responsibility for any damage that the products may suffer or cause. The recipient must check the condition of the products upon arrival and ensure that they are in all respects in conformity with the order. In the event of shortages, losses or damage, the Customer must make all reservations with the carrier responsible, specifying the nature and extent of the damage on the delivery slip. In order to allow AUTHENTIC SPIRITS to exercise its rights of recourse against the carrier, the Customer shall confirm, on the day of delivery, by e-mail to AUTHENTIC SPIRITS, the reservations it has made with the carrier. In the event of an apparent defect in the products delivered, the Customer shall have a period of forty-eight (48) hours from the date of receipt of the products to send a complaint by e-mail to AUTHENTIC SPIRITS, accompanied by a photograph clearly showing the deterioration. After this period, the products delivered will be deemed to be free of all apparent defects. AUTHENTIC SPIRITS will reimburse or replace, at its own expense, the products that do not conform or are affected by a defect. |
7. right of withdrawal and return
In accordance with the provisions of Articles L. 121-21 et seq. of the Consumer Code, the Customer has a period of fourteen calendar days from receipt of the last product of his order to exercise his right of withdrawal without having to justify his reasons or pay penalties, except for the cost of return which remains at his expense.
The transport of the returned products is the responsibility of the Customer. Any damage suffered by the products on this occasion being likely, as recalled below, to defeat the exercise of its right of withdrawal.
To exercise this right, the Customer must inform AUTHENTIC SPIRITS, within a period of fourteen (14) working days, of his decision to withdraw by any written means (letter, e-mail to the Customer Relations Department). If the seven (7) day period normally expires on a Saturday, Sunday or a holiday, it shall be extended until the next working day. Only products that have been returned by the Customer within fourteen days of the communication of his decision to withdraw, in their original packaging and on condition that they are suitable for resale, will be taken back. The products must not have been opened or opened. In the event of exercising the right of withdrawal, AUTHENTIC SPIRITS will reimburse the Customer for the sums paid, with the exception of the return costs, by bank transfer or by cheque, within a maximum period of seven days following receipt of the returned products.
8. product conformity
All goods and services may be represented photographically or iconically. AUTHENTIC SPIRITS uses its best efforts to ensure that these representations are as faithful as possible to the goods and services themselves. However, due to the virtual nature of the presentation of these goods and services, Customer's perception may differ from the goods and services themselves. The Customer acknowledges and agrees that all photographic and iconic representations are present for information purposes only.
It is expressly agreed that the Buyer shall become responsible for the products upon delivery, with delivery resulting in the transfer of risk to the Buyer.
Unless otherwise provided for by law, the liability of AUTHENTIC SPIRITS shall in no case exceed the value of the goods invoiced.

To exercise his rights, for any difficulty or additional information, the Customer may contact the Customer Service by e-mail at the following address: contact@authentic-spirits.com, or via the contact form available on the Site.
10. personal data protection policy
10.1 Purpose of the processing (purpose and legal basis)
The Site allows to receive the orders of the Customers and the data collected on this occasion are recorded and treated in a Customer file.
This file allows you to:
- Manage orders, payment and delivery;
- To carry out marketing operations (loyalty, promotions) and to send advertisements by e-mail to Customers who have not objected or who have accepted it.
10.2 Legal basis for processing
- Order management: the legal basis for processing is the execution of a contract.
- Sending commercial solicitations by e-mail on products similar to those ordered by the Customers: the legal basis of the processing is the legitimate interest of the company, namely to promote its products to the Customers.
10.3 Data Categories
- Identity: last name, first name, address, delivery address, telephone number, e-mail address.
- Order data: transaction number, purchase details, purchase amount, invoice payment data (payments, outstanding payments, discounts), product returns.
- Data necessary for the realization of loyalty and prospecting actions: purchase history.
10.4 Recipients of the data
- AUTHENTIC SPIRITS is the recipient of all categories of data.
- Its subcontractors, responsible for the delivery of its orders, are recipients of the identity, address and telephone number of the Customers.
10.5 Data retention period
- Data necessary for the management of orders and invoicing: for the entire duration of the commercial relationship and ten (10) years for accounting purposes.
- Data necessary for the realization of loyalty actions and prospecting: for the entire duration of the commercial relationship and three (3) years from the last purchase.
10.6 Customer's rights
To stop receiving advertising from AUTHENTIC SPIRITS (exercise of the right to object or withdrawal of consent already given), to access, rectify or delete data concerning him/her, or for any question about the processing of your personal data, the Customer may contact AUTHENTIC SPIRITS :

11. disputes
The present general conditions as well as all the operations referred to herein are subject to French law. In the event of a dispute, the Customer shall first contact AUTHENTIC SPIRITS to find an amicable solution. Failing this, the case will be brought before the competent courts.
12. intellectual property rights
The trademarks, logos, designs and models present on the www.authentic-spirits.com site are the exclusive property of AUTHENTIC SPIRITS.
Consequently, AUTHENTIC SPIRITS will take legal action, in particular for infringement, against all those who, directly or indirectly, infringe its rights.
AUTHENTIC SPIRITS also informs Customers and visitors that the Site is a protected work, as such AUTHENTIC SPIRITS is the owner of the existing copyrights on each of the pages constituting the Site, on its tree structure as well as on each of the elements appearing on it (photographs, texts...). In this respect, AUTHENTIC SPIRITS reminds you that any use or reproduction of any element of the Site is strictly prohibited.
